Saki wrote:i have a court summons for april next year for not having an L plate displayed... cause it fell off, but the cop didn't care. and that was worthy enough to goto court, even tho its a $50 fine and no points.

all i can say is,

WANKER!
I'd say you didnt secure it well enough so it probably still is your fault for not displaying one....

If a parking inspector doesnt stick the fine on your windscreen well enough and it flys off, you still got the fine, u just dont know about it for a while.

Mitch , surely you were just taking evasive action to avoid road debris that must have fallen off a truck , bolts an stuff that may have puntured your tyre and caused a nasty accident .

Your action were only made in the interests of your own safety and the safety of others following you .

And in Victoria , the copper is not likely to be in court , more likely to a prosecuting sergent reading a statement from the tosser handing out the ticket . Dunno about further North .

Good Luck

Mitch,

Fight it, if you enter a plea of guilty your penalty is a definate conviction, it you fight it you stand a chance of having a win. Get onto one of those solicitors that do a first consultation free and take note of what he says, no bullshit and no agro to the court and most magistrates will look favourably on you having travelled back into NSW to have your say. If you should lose, the penalty should not be much more than the original fine. If you win, woohoo, keep the licence and save a few bucks.

Kishy wrote:(He got pulled over for having this helmet on - No Standards sticker)..
Fair enough. The legislation requires either a sticker OR the sewn in standards tag. If there doesn't seem to be a sticker, that's a good enough reason to stop the rider and inspect the helmet. Keeping in mind that helmets that have the British Standards sticker/tag are also acceptable, and some helmets made by Arai. (At least, that's the rules in SA.)
Kishy wrote:I proved to the judge that the law/Australian standard was flawed. By proving that just because a helmet had a sticker and or a sewn in label that the helmet was no more safer than 1 that didnt.
Didn't he get pinched for not having an AS sticker/label tho? If it didn't have a sticker or label, how does it matter one iota if other helmets brought into the court are safe or not?
Kishy wrote:12. DO NOT give them permission to photograph it (if they do thats a down fall) If they ask you permission to inspect it,They then by law must seek your permission to photograph it.
Don't they seize the helmets interstate? Non-complaint helmets being used on the roads in SA are seized.
Kishy wrote:Read this over and over again writing down any indiscrepencies to that of what happened on the actual day (the cunts lie).
I can't see the point in coppers lying. I'm sure there's some that do, but if someone has committed an offence, then why not just write down the truth? If they haven't committed an offence, then let them go....
Kishy wrote:The fact that AS 1698 states that you must have either a sticker on the outside of the helmet, a label sewn in the inside of the helmet or both.
And here we get to the crux of the matter. Did the helmet he had on have either of those? If not, then that is all that matters. Everything else is totally irrelevant!
Kishy wrote:(proved by his first 3 questions to me)

1. Who do you ride with
2. Where is your club house
3. Do you know members of the *********** OMC
That's not really proof is it?
Q: Who do you ride with?
A: Uncle Tom and my Dad's mate Arthur.

Q: Where is your club house?
A: Well, the footy club I'm with can't actually afford a club house. We just meet up at the pub after a game.

Q: Do you know the members of blah blah MC?
A: No, why?
Q: One of them lent me a puncture repair kit the other week. I'm trying to find someone that knows them so I can get a kit back to him.
Kishy wrote:The coppa's lack of indepth knowledge of the standard
He didn't need one. Did the helmet have a sticker/label or not?

BTW, it's almost nice to see a well thought out, less gangster-talk like post out of you.
