I don't know this girl even though she's in Brisbane but I hope she gets well soon. Based on what I've read, I'm sure she'll pull through. Giving up is not an option.

Pity about the bike though...

i dunno if her medical is covered, but there will probably be sum re-hab costs when she heals up??

maybe a collection to assist the family, or her lost wages, medical etc would be a nice gesture...

let me kno..im in...

As I understand it she was on her way to work. If that is the case she should be covered by Workers Comp.

which is fortunate compared to if she was on the way home.

What i mean is, im not sure how on the way home from work is covered, but im aware that theres some tricky bits there, like if you had stopped at the shops on the way home etc it may not be deemed as covered.

You are covered on your normal path to and/or from work... stopping for fuel etc wouldn't be a drama, but going to a bike shop on the other side of town would be.

You need to check your scheme first - a lot of jurisdictions *do not* cover journey claims any longer - I know that if you are a Commonwealth employee, or covered by Comcare for insurance, you are no longer covered after 15 March :shock: - Any injuries suffered on journeys to/from work must be dealt with as a 3rd party claim through motor vehicle insurance....

Unless you have signed a new agreement (eg started a new job), or received a derogation notice (ie written confirmation of reduction in cover) then the cover is still the same as it was.

Insurance cover (statutory or otherwise) CANNOT be reduced without notice.

Not for Commonwealth employees. Until March 15, journey claims were covered by Comcare, the commonwealth insurer. Thanks to the recent passing of legislation by the incumbent overlords, this is no longer the case. Employees cannot claim through Comcare for any injuries suffered on a journey to/from work. End of story. Claims now have to be lodged through 3rd party insurers (NRMA etc).

There are a number of exceptions, mainly based on trips *for* work, to places of education etc, but your basic journey to/from work claim is gone. This applies to all current and future c'wealth employees, not just new starters.

I guess the *written* confirmation of this is in the public notification of the new laws, there was nothing sent out to individual commonwealth employees about this change. I have managed Comcare claims for over 10 years, have done stacks of journey claims, normally they were one of the easiest to deal with.........

Individual State-based insurers (WorkCover, QComp, etc), have their own rulings in their own States - I think TAC provides all the coverage in Vic, not Vic WorkCover for journey claims.

I know its a bit off-topic, our thoughts at this time are with Sasha for a full recovery, but insurance claims are right at the top of the list of red-tape that inevitably follows a prang.
