Fines for Swearing

I may have mentioned once or twice :lol: That the Totalitarian Governments take away your freedoms Bit by Bit ;)

"The Victorian Government plans to introduce laws this week that will give police permanent power to issue on-the-spot fines to people who swear.

Under the proposed legislation, people could be fined close to $240 for language that is considered indecent or offensive.

Attorney-General Robert Clark says the changes mean police will not have to use the courts to deal with people who use bad language.

"We're going to be confirming the power of police to issue on-the-spot infringement notices for these sorts of offences, which will free up police resources," he said.

"It will also enable them to more effectively act against the sort of loud-mouthed, obnoxious behaviour that can make going out to public places unpleasant for other members of the public."


How's that for freedom of speech ??? (and dont think this new power will not be ABUSED)

As the law stands at the moment, I'm sure you'll find it's the same as it is here in SA. You use indecent or offensive language in a public place, you risk being locked up. This means the whole going to court saga and wasting a shit load of peoples time. By introducing an on the spot fine for offensive language, you potentially free up some of the court system.

We're not talking about sitting around with your mates throwing around a few choice words. We're talking about you being on the street, acting like a dickhead and using indecent or offensive language. Personally, I think it's fair enough. I for one do not want to be at a shopping centre with my children and grandmother (who is a nun) whilst some tool feels he/she has the right to offload a barrage of obscenity.

I would've thought that a cop is more likely to give you an on-the-spot where there's no court appearance for them unless you decide to defend it, rather than a definite court appearance where they would have to justify it to the judge every time.

Sorry, but I reckon it does open it up to more abuse by a cop who's looking for something to slap on someone who's failed the attitude test. At least with a speeding fine there's a cut and dried measure of whether an offence has occurred, but with this one it's all down to what's considered "indecent or offensive". That's a pretty broad and hugely subjective definition.

This was attempted in NSW a while ago and was thrown out as it is impossible to prove what one person finds offensive to another. Will not be enforceable in court.

Only problem is we dont have "Freedom of speech" in our constitution, so we can be censored!

I reckon it's fair enough. It's pretty well how it used to be anyway back in the day. So long as it's used sensibly I don't see a problem.

So the next time a cop tells me ,I dont like your attitude while he hunts for something to defect me for, i can then reply the same without getting booked ?? I dont think so ;)
