Wheres the letter ?

Post by FrogZ »

A far while back someone posted a "template" letter to be used when writing to the Police re questioning a charge or disputing an infringement.
I have tried to do a search to find out but have had no luck.
Hoping someone else either remembers it or is better at using the search engine than me.....

HELP ! (Not for me this is for someone else but I am asking)

Dear Sir or Madam:

Re: Notice of Intended Prosecution number

I have received a notice of intended prosecution/request to identify the rider of a vehicle in relation to an allegation of an offence on <DATE OF OFFENCE>

I am aware that I have a duty to take reasonable steps to provide the information required in the notice. I take this duty seriously and I am therefore anxious that any information provided is accurate. I am also anxious to deal with this matter promptly. I am not the only person who has access to and authority to drive this vehicle and I am unable to confirm who was driving it on the day. I would therefore be obliged if you would provide the following to assist me to comply with your notice :

(a) a copy of any photographs and/or video taken of the vehicle concerned, whether or not this is able to show the rider;
(b) confirmation of the exact location of the alleged offence;
(c) where evidence was obtained by recording device, confirmation of the type of device used (including make and model), a copy of the up-to-date certificate of calibration, confirmation of the date of calibration and details of the method used; and
(d) where the recording device was mobile, details of the operator, their qualifications and the operator training received by them.

I trust that until such time as the photograph or other evidence is provided (allowing two days for postage under the usual rules of service) the 28-day period will not start to run.

Yours faithfully

na he's just obsessed with speeding and getting away with it.
There he goes. One of God's own prototypes. Some kind of high powered mutant never even considered for mass production. Too weird to live, and too rare to die.

The trick to getting away with it is not getting caught in the first place.. generally you're completely rooted once you are caught!

There was an article in sundays paper about the system having loop holes & one stand out was companys paing larger fines (no loss of points) because they could not prove who was driving at the time..... so the rich use fictious companys to get out of losing points just pay more + it went on to say thet people were selling their demerit points so they dont lose their licence! :shock:
Think it said something like $200 - $500 per point :shock:

One of the other lurks is with international drivers mainly business associates who are over in Australia on short term visas with loan cars from the company being nominated for speeding offences they did'nt do
Result is that the company complies with the act by identifiying the operator of the vehicle and the authorities drop the follow through because its too hard
Nostradamus probably got it right

if ur in adelaide..and u know a young person trying to make a living working only the odd casual shift..and said person has 12 points left..said person might take 3 points for $100..if said person is desperate to pay the rent....

all hypothetical here of course..
